Issue:
The City needs right of entry to maintain a stormwater culvert, which is located on private property.  An easement is needed so City staff can legally enter the property.

Move to approve and authorize the City Manager to sign a Utility Easement with J. Brian Hovis and Deborah J. Ross, property owners at 1413 Frederick Street SE.

Background and Analysis:
The City maintains a culvert through which Indian Creek flows. The culvert is partially on private property and continues under Olympia Woodland Trail (OWT). The culvert dates back to the construction of the former railway, now serving as OWT. In order to prevent washouts and flooding, City staff routinely clear debris that collects at this location. This routine maintenance prevents property damage to the owner and the City. While no right of entry to the property by easement appears on record, the arrangement has been amicable and now needs to be formalized.
J. Brian Hovis and Deborah J. Ross, the property owners, have agreed to the terms of the formal Utility Easement and signed the document. Therefore, staff is recommending the City Council approve the Utility Easement.

Formalizing the utility easement places notice in public records for current and future property owners.

The property owners granted the Utility Easement in exchange for payment of $500.00.
