Hold a public hearing on the petition to vacate a portion of East Bay Drive at 1929 East Bay Drive.  After close of testimony, if there are no concerns, move to approve the petition to vacate, direct staff to prepare a Vacation Ordinance, and require payment to the City of one-half the appraised value.

Whether the City Council should hold a public hearing, approve the petition to vacate a portion of a portion of East Bay Drive at 1929 East Bay Drive and direct staff to prepare a Vacation Ordinance for future action.

Background and Analysis:

A property owner adjacent to East Bay Drive requests the City initiate the process to abandon a portion of East Bay Drive adjacent to the northeast corner of their parcel at 1929 East Bay Drive. The additional property is already being used by the parcel owner as yard and is a portion of East Bay Drive that was overlooked in previous street vacations from 1912 (Ordinance No. 1211) and 1982 (Ordinance No. 4363), which created an area which is not used as right-of-way.

 

On April 25, 2022, Council adopted a resolution setting the date of May 24, 2022 for a public hearing to hear public comment regarding the request.

 

City staff reviewed the request using the criteria outlined in Olympia Municipal Code Section 12.16.100.

 

Staff recommends approval of the vacation with the requirement to make payment of one-half appraised value to the City.

 

Neighborhood/Community Interests (if known):

The public hearing will provide an opportunity for Council to hear comments from the community regarding the requested vacation.

 

 

 

Options:

1.                     Hold a public hearing on the petition to vacate a portion of East Bay Drive at 1929 East Bay Drive.  After closing the hearing, if there are no concerns; approve the petition to vacate, direct staff to prepare a Vacation Ordinance, and require payment to the City of one-half the appraised value.

2.                     Hold a public hearing, approve the petition to vacate a portion of East Bay Drive with additional conditions, and direct staff to prepare a Vacation Ordinance.

3.                     Hold a public hearing and do not approve the petition to vacate a portion of East Bay Drive. This option leaves the street right-of-way as is. 

 

Financial Impact:

There is no financial impact to hold the public hearing to consider vacating a portion of East Bay Drive at 1929 East Bay Drive
