Issue:
Public Works staff in the Water Resources Groundwater Protection Program needs recurring access to property owned by Indian Summer LLC, first to install and check a groundwater monitoring well within the Indian Summer Golf & Country Club, up-gradient of the City's Shana Park water source.

Background and Analysis:
The Drinking Water Utility is adding two groundwater monitoring wells to the City's Shana Park drinking water protection area (DWPA). These wells will serve as sentinel wells to provide water level and water quality information ahead of a possible contaminating event.  One of these wells, MW-25, is proposed to be installed on Indian Summer Golf & Country Club property, within the Shana Park DWPA 6-month time-of-travel capture zone.  Staff has successfully negotiated an easement agreement with Indian Summer LLC and plans to install the well this summer (2013), with monitoring continuing into the future.
Neighborhood/Community Interests (if known):
Indian Summer LLC, on behalf of the Indian Summer Homeowners Association, has requested the City use natural materials or existing high vegetation to screen the well from view of the golf course guests and participants. This detail has been specified in the easement agreement.
Options:
1.      Approve and authorize the City Manager to sign the easement agreement with Indian Summer LLC.
a.      Will enable staff to finalize the project as originally planned.
b.      Is consistent with the agreement negotiated with Indian Summer LLC.
 
2.      Decline authority to sign the easement agreement.
a.      Staff would need to seek an alternative location for a monitoring well.
b.      The Utility would not have the necessary easement for well installation and long-term monitoring at this preferred location.
Financial Impact:
The Drinking Water Utility will incur a one-time cost of $1,500 to Indian Summer LLC in consideration of the easement. (The well will also incur installation, equipping, and monitoring costs which have been approved in the 2012 Drinking Water Capital Facilities Plan.)
