SEPA Determination:                        Pursuant to the State Environmental Policy Act, the Port of Olympia  (Lead Agency) issued a Mitigated Determination of Non-significance on February 11, 2014. The comment deadline was February 25, 2014. No appeals were filed with the Port by the March 18, 2014 appeal deadline. 

 

Public Notification:                       Public notification for this hearing was mailed to property owners within 300 feet of the subject property, recognized neighborhood association(s), and posted on-site on April 2, 2014; and published in The Olympian on April 4, 2014, in conformance with Olympia Municipal Code (OMC) 18.78.

VI. RECOMMENDATION

 

1.                     Construction of those portion of the project within the shoreline jurisdiction shall not begin until after the date of filing the Hearing Examiner’s decision with the Department of Ecology, or until all review proceedings initiated within 21 days from the date of filing have been terminated (WAC 173-27-190). Since time is of the essence under the Ecology Administrative Order # 9661 dated December 18, 2011, portions of the project outside the shoreline jurisdiction may commence immediately.

2.                     Should contaminated soils be encountered during construction all of the following shall apply:

a.                     Construction activity shall be immediately suspended;

b.                      The contractor shall immediately notify the Washington State Department of Ecology; and

c.                     Contaminated materials shall be properly handled, characterized, and disposed of consistent with applicable regulations. 

 

3.                     The applicant shall submit detailed design review application to the lead planner containing:

a.                     Color and Materials (18.150.070);

 

b.                     Final Landscape Plans (18.150.080); and

 

c.                     Signs (18.150.100), if any,

with the building permit application pursuant to OMC 18.100.110(B).

 

4.                     The applicant’s final Landscape planting plan shall confirm the 9.5 Tree units needed to address the 4,800 sq. ft. of “disturbed area” pursuant to OMC 16.

5.                     Because of sound transmission across water to nearby residences; and, in addition to the 7 AM to 10 PM limitations placed on construction noise activities contained in the Port MDNS, the applicant shall further limit any earth vibrations or concussions to the hours between 7:00 a.m. and 6:00 p.m. pursuant to OMC 18.40.080(C)(7).
