Issue:
Bates Technical College utilizes the Fire Training Center facility and pays the City of Olympia for that usage. The City uses Bates to supply instructors for some classes at the Fire Training Facility. The current contract does not adequately describe the arrangement for Bates to supply that instructor pool to the City. This new contract continues the provisions of the existing contract for Bates' use of the facility and captures details of the provision of instructors for the City.

Background and Analysis:
Bates utilizes the Fire Training Center facility and pays the City of Olympia for that usage. Bates also provides instructors for some teaching at the Fire Training Center. The existing contract does not adequately describe the Bates-City of Olympia relationship for instructors so this modified document was prepared at the request of both parties.
 
The agreement you are being asked to approve is substantially the same as the "temporary" contract you approved on July 8, 2014. This agreement supersedes the agreement of July 8, 2014. Changes include language needed to support the following additions:
 
The City will have access to a cadre of instructors, pre-approved by the Olympia Fire Department.
 
At the request of the City, Bates will provide instructors and college courses for instruction assignments at the Fire Training Facility.
 
Whenever possible and appropriate, Bates will provide these courses for college credit.
 
The City will pay Bates an instructor fee of $55.00 per hour based upon an hourly cost of training provided. All wages and benefits for these instructors will then be paid by Bates directly to the instructors.
 
The City will pay a flat rate of $150.00 per month for a college affiliation fee.
 
Liability and Indemnification of the City is addressed.
 
The City of Olympia and Bates have had a working agreement for a number of years that allows exchange of services. This latest version better describes the exchange of services and adds college credit and/or certification for firefighters being trained.
 
Both parties have undertaken the project of creating this superseding agreement that will serve the parties and participating students well for years to come.

Financial Impact:
Per the Agreement, Bates pays the City a rental fee of $72.50 per hour plus tax. The City pays Bates $55.00 per hour for instructors and a $150.00 per month, College Affiliation fee. The costs to the City are recovered from the students and/or departments receiving the training at the Olympia Fire Training Facility.
 
Approving this agreement supports the long standing business arrangement between Bates and the City and is an integral component of the Fire Department's Fire Training Facility Business Plan.
