Move to approve and authorize the City Manager to sign the proposed Agreed Order, or one substantially similar, and all related documents between the City of Olympia and the Washington State Department of Ecology for implementation of the Cleanup Action Plan for final remediation of the new City Hall site.

Background and Analysis:
In January of 2008, the City selected the old Safeway site for the new City Hall.  Both the seller and the City completed environmental assessments indicating the presence of contamination at the site.  On May 16, 2008, the City entered into Agreed Order No. DE 5446 with the Department of Ecology (Ecology), which covered the remedial investigation, interim action, feasibility study and draft cleanup action plan.  
 
The City performed extensive remediation work as a part of the interim action covered by the existing Agreed Order.  A new Agreed Order is necessary to cover the final remediation activities at the site.  As indicated by the proposed Agreed Order which is set forth in Attachment 1, the remaining cleanup actions proposed are replacement of a ground water monitoring well, additional ground water monitoring, development of a contingency plan depending on the results of the groundwater monitoring, and the recording of a restrictive covenant on the property.  The final draft cleanup action plan is set forth in Attachment 2.
 
After the City signs the attached proposed Agreed Order, Ecology will begin a 30-day public comment period on September 5, 2012, for the proposed Agreed Order, the Remedial Investigation/Feasibility Study and the Draft Cleanup Action Plan.  Following the comment period, if no substantive comments are received, Ecology will sign the Agreed Order and the Cleanup Action Plan can be implemented.

Ecology will accept public comment beginning September 5.
 
Options:
1.  Approve and authorize the City Manager to sign the Agreed Order as written.
2.  Request amendments to the Agreed Order.
3.  Do not approve the Agreed Order.
 
Financial Impact:
Adequate funding exists in the current budget to cover the requirements of the proposed Agreed Order.
