Background and Analysis:
The City discovered soil contamination during the Percival Landing Phase 1 construction and worked with the Department of Ecology (DOE) and County Health to perform cleanup activities. Since the source of the pollutants appeared to be due to separate sources, the Phase 1 cleanup was divided into two sites. The northern site, which is from Olympia Ave to the north side of the Harbor House, and the southern site, which is from Olympia Ave south to the north wall of Les Schwab building. The cleanup on the northern site removed most of the contaminant, but left small amounts of petroleum products at low concentrations, more than 6 feet deep and under the concrete and wooden sections of the boardwalk. DOE has reviewed the cleanup actions performed by the City at the site and is requiring the recording of the attached Environmental Covenant.
This Covenant places limitations on future activities that could impact soil or groundwater at the site. The Covenant will be recorded with the property title. The Covenant will restrict the following:
* use of groundwater from the site for potable water
* excavation in the southwest corner that will impact the existing concrete or wooden walkway without prior approval of DOE
* building of any structure on the property without vapor intrusion protection.
None of these restrictions will limit the City's intended use for the site.
