Background and Analysis:
The City currently has rights to an abandoned utility easement and abandoned storm water pipe within Lot 1, Henderson Commercial Park Binding Site Plan (see attached map). The utility's storm water pipe was abandoned and rerouted in 2007. A new easement was granted to the City over the rerouted storm water pipe. The original easement was inadvertently not released at that time. The property owner desires that the City release the utility's easement rights to clear title and allow for development of the site.

Staff is proposing that Council declare this abandoned utility easement, and the pipe buried therein, as surplus and to hold a public hearing in the future regarding its disposition.
