Background and Analysis:
 
The Memorial Clinic building, located at the approximate corner of Lilly Road and 11th Ave NE, has an unneeded waterline easement running under the building.  The water line itself was moved to the north of the building a number of years ago, but the City did not obtain a new easement for that waterline.  A proposed sale of the property is currently pending, and the inadequacy of the easements has been identified by the owner's attorney as a title issue that should be cleared of record.
 
Olympia Municipal Code 3.16.020(B)(1) authorizes the Public Works Director to accept the easements that are part of development projects.  However, the easement release, which in this case is necessarily integrated with the easement, requires City Council approval.  Therefore, staff requests that Council consider and approve the easement document which also includes the easement release within it.
