Background and Analysis:

As a condition of financial assistance provided to the Hands On Children’s Museum (HOCM) by the Washington State Department of Commerce, the City must execute a Restrictive Covenant. This Restrictive Covenant will ensure that certain City-owned property remains dedicated to use as a children’s museum for ten years. The Restrictive Covenant will be recorded with the Thurston County Auditor and will run with the land for a ten-year term, after which Commerce will issue a Release of Restrictive Covenant to the City of Olympia.

Options:

1.                     Move to approve the Resolution Authorizing the City Manager to Sign a Restrictive Covenant Dedicating the Use of City-Owned Property for a Children’s Museum for Ten Years.

2.                     Move to approve the Resolution with Council-directed modifications.

3.                     Decline to approve the Resolution, which may jeopardize HOCM’s financial assistance from the Department of Commerce.
