Issue:
The City needs to maintain a sanitary sewer lift station, which is located on private property. An easement is needed so City staff can legally enter the property.

Background and Analysis:
The existing sewer lift station located at the northwest corner of Edison Street and Yew Avenue was built in 1968. It has been maintained and operated over the years with the understanding it was located within City right-of-way. The City no longer has rights to this portion of right-of-way. A street was never constructed at this location in order to maintain these rights. Now, the City needs to have a formal agreement with the adjacent property owner to access and maintain the lift station.
 
Mary M. Collins, the property owner, has agreed to the terms of the formal Utility Easement and signed the document. Therefore, staff is recommending the City Council approve the Utility Easement.

Options:
Approve and authorize the City Manager to sign a Utility Easement with Mary M. Collins, property owner at 1904 Yew Avenue NE. City staff will be able to legally access and maintain the sanitary sewer lift station.
